Terms of Service for Volume Visualizer
Effective date: June 28, 2026
These Terms of Service (“Terms”) govern your use of Volume Visualizer (“the app”), published by Brent Nicholson (“we,” “us,” or “our”). By downloading, installing, or using the app, you agree to these Terms. If you do not agree, do not use the app.
1. License
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the app on Apple devices that you own or control, in accordance with the Apple Media Services Terms and Conditions and the Licensed Application End User License Agreement (the “Apple Standard EULA”). Volume Visualizer is offered as a one-time purchase; there is no subscription. Where these Terms and the Apple Standard EULA conflict, the Apple Standard EULA governs for app obtained through the App Store.
2. Ownership
The app, including its design, code, and content, is owned by Brent Nicholson and is protected by intellectual-property laws. These Terms do not transfer any ownership rights to you. All rights not expressly granted are reserved.
3. Acceptable use
You agree not to:
- copy, modify, or create derivative works of the app, except as permitted by law;
- reverse engineer, decompile, or disassemble the app, except to the extent this restriction is prohibited by applicable law;
- rent, lease, lend, sell, redistribute, or sublicense the app; or
- use the app for any unlawful purpose.
4. Your data and backups
The app can move files and folders to the macOS Trash at your direction. You are solely responsible for the data on your devices and for deciding what to remove. Although the app moves items to the Trash rather than permanently deleting them, you should maintain current backups of your important data. We are not responsible for any loss of data resulting from your use of the app.
5. Disclaimer of warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY RESULTS OBTAINED FROM USE OF THE APP WILL BE ACCURATE OR RELIABLE.
6. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL Brent Nicholson BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID FOR IT. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
7. Purchases and refunds
The app is sold through the Apple App Store. All purchases, billing, and refunds are handled by Apple under the Apple Media Services Terms and Conditions. We do not process payments and cannot issue refunds directly; please direct refund requests to Apple.
8. Privacy
Your use of the app is also governed by our Privacy Policy, which describes how the app handles information (in short: everything stays on your device).
9. Apple as third-party beneficiary
You acknowledge that these Terms are between you and Brent Nicholson only, and not with Apple. Apple is not responsible for the app or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you. Apple has no obligation to furnish any maintenance or support for the app.
10. Termination
These Terms remain in effect until terminated. Your rights under these Terms end automatically if you fail to comply with them. Upon termination, you must stop using the app and delete all copies.
11. Changes
We may update the app and these Terms from time to time. When we change these Terms, we will revise the “Effective date” above and post the updated version at https://volumevisualizer.app. Your continued use of the app after changes take effect constitutes acceptance of the revised Terms.
12. Governing law
These Terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict-of-laws principles, except where applicable consumer-protection law requires otherwise.
